Can I exchange my rented modem for a newer model?

We posed this question to Qwest and this was the response we received:

"As part of the current DSL service agreement, Qwest provides a modem warranty that guarantees a like replacement. If you are experiencing problems with your modem, Qwest will replace it with the same modem as long as the modem is rented from Qwest. The modem rental program is not a technology guarantee and does not allow for exchanges or upgrades to newer models. If you would simply like to upgrade to a newer model, you can purchase, rather than rent, a new modem by calling Qwest."
